Terms and Conditions

  • 1. Subject of the Service

  • 1.1. This agreement governs the contracting of the production service for a custom 3D avatar model, in accordance with the specifications and guidelines provided by the CLIENT.

  • 2. Deadlines and Deliveries

  • 2.1. The standard timeframe for the project's completion and delivery is 1 (one) week, starting from the date of payment confirmation and the receipt of all necessary materials.

  • 2.2. This timeframe may be extended to a maximum of 4 (four) weeks, depending on the project's complexity. The CLIENT will be notified of any need to extend the deadline.

  • 2.3. In exceptional circumstances, such as health emergencies or force majeure events that divert focus from the project, the deadline will be paused and renegotiated with the CLIENT, without prejudice to either party.

  • 3. Materials and Resources (Assets)

  • 3.1. The CLIENT is responsible for providing all necessary assets for the avatar's production, including, but not limited to: base models, clothing, hair, textures, and other accessories.

  • 3.2. The quality and conformity of the provided assets are the sole responsibility of the CLIENT. The use of low-quality materials may impact the final result of the project.

  • 4. Usage Rights and Responsibilities

  • 4.1. The final avatar model is for the exclusive use of the CLIENT.

  • 4.2. If the project uses a third-party base or assets, the terms of service of the original creator of those materials remain in effect. The CLIENT declares to be aware of and agrees to abide by such terms.

  • 4.3. The service provider is not responsible for any violation of the terms of use of third-party assets committed by the CLIENT.

  • 5. Alterations and Adjustments Process

  • 5.1. The CLIENT is entitled to a total of 5 (five) requests for minor or medium complexity adjustments during the project's development phase.

  • 5.2. Alterations that exceed this limit or that substantially modify the initial scope of the project may be considered an extra service, subject to additional charges upon the CLIENT's prior approval.

  • 5.3. Corrections of technical issues or errors originating during the production process will be carried out at no additional cost.

  • 6. Project Finalization and Delivery

  • 6.1. Upon final approval by the CLIENT, all local work files used by the service provider will be permanently deleted.

  • 6.2. The complete project will be delivered to the CLIENT in its final version. This will be the only version made available.

  • 6.3. It is the exclusive responsibility of the CLIENT to make backup copies of the received files to prevent accidental loss.

  • 7. Additional Services and Charges

  • 7.1. The contracted service is strictly limited to the scope and package previously agreed upon.

  • 7.2. Any services not stipulated in the initial discussion will be considered extras and will only be executed after discussion, quotation, and express authorization from the CLIENT.

  • 8. Post-Delivery Support

  • 8.1. It is understood that all questions and requests for aesthetic or visual changes must be made before the final approval and delivery of the project.

  • 8.2. After delivery, support will be focused exclusively on technical adjustments (e.g., bug fixes) and clarifying critical questions about the model's functionality. No new aesthetic changes will be made.

  • 9. Payment Conditions

  • 9.1. All amounts and payment methods will be detailed and agreed upon before the project begins.

  • 9.2. The execution of any additional service, with its respective charge, will only occur after the explicit approval of the CLIENT.

  • 10. Acceptance of Terms

  • 10.1. By contracting the services, the CLIENT declares to have read, understood, and agreed to all the terms and conditions set forth herein.Terms and Conditions
